It's Started In Hong Kong...2

The Hong Kong Court Recognized The Validity of an Overseas Same-Sex Marriage.  The Hong Kong Government's Denial of Spousal Benefits To a Same Sex Couple, Legally Married Overseas, Was Indirect Discrimination And Discrimination On Sexual Orientation

1.  And.....BANG..!!...right there in Part 1, is the judicial catalyst that will trigger a wholesale analysis of "gayness" in Hong Kong.

2.  At the moment, there is no gay marriage in Hong Kong and, until the Judgment we set out in Part 1, there was no legal or judicial recognition of overseas same-sex marriages either.  In the absence of the Hong Kong Government launching a successful appeal to the Court of Appeal (unlikely, in our view - the operative words being "successful appeal"), the Court has sent the Government a very clear message:  there are NO grounds for you NOT to recognize an overseas legalized same-sex marriage as a reason to deny spousal benefits in the Civil Service.

3.  We haven't read the 44-page Judgment (we're attempting to get it) but we'll say this:
  • The Government is the largest employer in Hong Kong;
  • We would not be surprised if there were other local Chinese civil servants who (secretly) had a valid same-sex marriage overseas and will now come forward to the Government requesting spousal benefits (whether they come out to their families, is another matter);
  • Some major private sector companies and banks in Hong Kong already have an internal policy to grant spousal benefits to legally married same-sex couples.  These are the companies with an international footprint and transient or long-staying expatriate employees.  The Court's decision merely ratifies their policies;
  • Smaller private sector sole-proprietorships, firms and companies (yes fags, there is a difference between a firm and a company - a "firm" is a Partnership; a "company" is a Limited Liability entity) will now have to sit up and take notice.
  • The traditional Chinese billionaire patriarchal organization (which may, or may not, be listed on the Hong Kong Stock Exchange), where the founder's black and white portrait (or if he expired, together with a framed picture of his tombstone), still hangs at a steep angle in a dark and musty corner of the office, now have a problem on their hands.....the younger generation of their successors are Western educated (usually Ivy League in the US or Oxford and Cambridge in the UK where there are no shortage of fags).  For better or worse, these guys have come back more "liberal" and sometimes more "politically correct".  Worse, they may even be gay themselves.  Expect some lively conversations at family "yum cha" with grandad on whether to grant similar benefits to their employees or face the threat of adverse publicity and legal action;
  • The Court's decision has thrown open the question, "if Hong Kong courts are recognizing valid same-sex marriage overseas, when will gay marriage be legalized in Hong Kong..?"
  • Currently in Hong Kong (as at May 2017), there is no law to specifically protect against workplace discrimination on the grounds of sexual orientation. The Court's decision on same-sex spousal benefits will accelerate the movement for such a law, that has been talked about for some time.
  • Expect the Equal Opportunities Commission, that has already voiced its support for gay marriage in Hong Kong to become more vocal in its calls for such legislation together with legislation for workplace protection;
  • The "family values" crowd are now fucked.  On the one hand they abhor the idea of men sucking each other's cocks.  On the other hand, they require "Ah Wing's" financial support and are counting on it as they grow older.  As the legislative changes roll in - and they will - expect "Ah Wing" to grow some balls and inform his esteemed parents, "look here, I'm gay and I might wanna get married either in Hong Kong or overseas. If you'll still accept me as your son and respect my partner if I get married, that's cool.  If not, find another ATM".
  • We have said before in this blog, that whilst we support same-sex relationships (and monogamy) we do not support "gay marriage" because it is infected with the religious and guilt-trip baggage of the Morality Militia.  Rather, we support Civil Union (a separate but equal option that should be open to BOTH str8 and gays).  Who knows....perhaps in the future, Hong Kong will have the option of both marriage and civil union, regardless of sexual orientation.  That would make FuelMix happy and completely fuck the Morality Militia.
